Sending a notice of infringement

Under 17 U.S.C. § 512(c)(3), your notice must be in writing and include:

1. A physical or electronic signature of a person authorized to act on behalf of the owner of the right claimed to be infringed.
2. Identification of the copyrighted work claimed to have been infringed or, if several works are covered by one notice, a representative list of them.
3. Identification of the material claimed to be infringing, with information reasonably sufficient for us to locate it: the game's page or play link (for example https://iridiangames.com/play/g-xxxxxxxx) and, where you can, what in the game infringes.
4. Your contact information: address, telephone number and email address.
5. A statement that you have a good-faith belief that the use of the material is not authorized by the copyright owner, its agent, or the law.
6. A statement that the information in the notice is accurate and, under penalty of perjury, that you are authorized to act on behalf of the owner of the right claimed to be infringed.

When we receive a complete notice we take the game down promptly, which stops it loading for everyone, and tell its creator, who may send a counter-notice. Under 17 U.S.C. § 512(f), anyone who knowingly misrepresents that material is infringing may be liable for damages.

Sending a counter-notice

If your game was taken down because of a copyright notice and you believe that was a mistake or a misidentification, you may send a counter-notice to the agent above. Under 17 U.S.C. § 512(g)(3) it must include:

1. Your physical or electronic signature.
2. Identification of the material that was removed and where it appeared before it was removed (the game's id or link).
3. A statement under penalty of perjury that you have a good-faith belief the material was removed or disabled as a result of mistake or misidentification of the material.
4. Your name, address and telephone number, and a statement that you consent to the jurisdiction of the Federal District Court for the judicial district in which your address is located (or, if your address is outside the United States, any judicial district in which Iridian LLC may be found), and that you will accept service of process from the person who sent the original notice or that person's agent.

We forward a complete counter-notice to the person who sent the original notice and tell them we will restore the game in 10 business days. Unless our agent first receives notice from them that they have filed a court action seeking to restrain the alleged infringement, we restore the game no less than 10 and no more than 14 business days after receiving the counter-notice.

Repeat infringers

We terminate the accounts of repeat infringers. An account whose games have been taken down for copyright infringement 3 times is banned: it can no longer sign in, upload or list games. A takedown we reverse because it was a mistake, or because of a valid counter-notice that was not followed by a court action, does not count. We may also terminate an account sooner where the circumstances warrant it.
